• Professional, employment, and non-public education information is collected when you apply for a job with E Ink and includes your former employers and job positions, alma maters, and educational records.

Sensitive Personal Data

• In some instances, and only when required for a legal basis described below, we may need to collect the following Sensitive Personal Information: government identifiers (social security number, driver’s license, state or government identification card, passport number); racial or ethnic origin; health information; religious or philosophical beliefs; and *financial information.

Personal Data provided by you to E Ink

• You may disclose Personal Data to us when you contact us via e-mail or telephone, or provide your Personal Data as part of an application for employment at E Ink. When using our Site, you may provide personal data when completing a registration form or completing a transaction.

Personal Data obtained as part of a business relationship or proposed business relationship

• We may obtain your Personal Data directly from you when you collaborate with us as part of a business relationship or proposed business relationship such as research projects, in an advisory/consultancy capacity, or providing goods or services to E Ink.

PERSONAL INFORMATION RIGHTS UNDER THE CALIFORNIA CONSUMER PRIVACY ACT

• After submitting a confirmed and verified request, Consumers have the right to obtain from us the categories of personal information we collected from you, the categories of sources for the personal information we collected from you, our business or commercial purpose for collecting the information, the categories of third parties with whom we share your personal information, and the specific pieces of personal information we collected about you (also called a data portability request). If we sold or disclosed your personal information for a business purpose, we will provide two separate lists disclosing: sales (identifying the personal information categories that each category of recipient purchased) and disclosures for business purposes (identifying the personal information categories that each category of recipient obtained). Correction and Deletion

• You may request that we correct inaccurate personal information maintained by us. You may request that we erase (delete) your personal information, subject to certain exceptions. Personal Information Sales Opt-Out and Opt-In Rights; No Sale

• While California residents have the right to opt-out of the sale of their personal information under the CCPA and CPRA, we do not sell personal information to any third parties, and therefore, we have not included a “Do Not Sell My Personal Information” link on the Site. If our practices change, we will update this Privacy Policy and take any other necessary action to comply with applicable law.

• Additionally, we do not intend to market to any individual under the age of 18, and we expressly prohibit anyone under the age of 16 from disclosing or submitting any personal information to us throughout the Site or other means. “Processor”

• shall mean a natural or legal person, public authority, agency, or any other body which processes personal data on behalf of the data controller.

• has the meaning ascribed to it in Section 4.

• You are solely responsible for your communications within Official Forums and Official Social Media Accounts, the consequence(s) of posting these communications, and your reliance on any communications in these areas. If you feel threatened or believe someone else is in danger, contact your local law enforcement agency immediately.

• E Ink and its subsidiaries do not represent that the User Content posted or otherwise provided on Official Forums or Official Social Media Accounts is accurate, complete, reliable, useful, timely, or current. You read all User Content at your own risk. Do not rely on the information or advice in any User Content.

a. Post, upload, share, transmit, distribute, facilitate distribution of, or otherwise make available, through or in connection with E Ink Websites, Official Forums, and Official Social Media Accounts:

e. Interfere with or disrupt the operation of E Ink Websites, Official Forums, and Official Social Media Accounts, or with the servers or networks used to make them; or violate any requirements, procedures, policies or regulations of such networks.

f. Restrict or inhibit any other person from using E Ink Websites, Official Forums, and Official Social Media Accounts (including without limitation by hacking or defacing any portion of E Ink Websites, Official Forums, and Official Social Media Accounts).

g. Use E Ink Websites, Official Forums, and Official Social Media Accounts to advertise or offer to sell or buy any goods or services for any business purpose, without E Ink's express prior written consent.

h. Reproduce, duplicate, copy, sell, resell or otherwise exploit for any commercial purposes, any portion of, use of, or access to E Ink Websites, Official Forums, and Official Social Media Accounts.

i. Modify, adapt, translate, reverse engineer, decompile or disassemble any portion of E Ink Websites, Official Forums, and Official Social Media Accounts.

j. Remove any copyright, trademark or other proprietary rights notice from E Ink Websites or materials originating from E Ink Websites, Official Forums, and Official Social Media Accounts.

k. Frame or mirror any part of E Ink Websites, Official Forums, and Official Social Media Accounts without E Ink's express prior written consent.

l. Create a database by systematically downloading and storing E Ink Content.

m.Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, "scrape," "data mine" or in any way gather E Ink Content or reproduce or circumvent the navigational structure or presentation of E Ink Websites, Official Forums, and Official Social Media Accounts.

a. evaluate User Content before allowing it to be posted on E Ink Websites, Official Forums, and Official Social Media Accounts;

b. monitor User Content;

c. alter, remove, reject, or refuse to post or allow to be posted, without notice to you, any User Content, for any reason or for no reason whatsoever; provided, however, that we shall have no obligation or liability to you for failure to do so or for doing so in any particular manner;

d. terminate accounts on or prohibit access to E Ink Websites, Official Forums, and Official Social Media Accounts; and/or

e. disclose any User Content, and the circumstances surrounding its transmission, to any third party in order to

• operate E Ink Websites, Official Social Media Accounts, and Official Forums;

• protect E Ink, the Affiliated Entities, and their respective employees, officers, directors, shareholders, agents, and representatives, and users and visitors on E Ink Websites;

• comply with legal obligations or governmental requests;

• enforce these Terms of Use;

• for any other reason or purpose consistent with applicable law and these Terms of Use.
